Text Messaging Terms and Conditions

These Text Messaging Terms and Conditions (“Terms”) govern the SMS and MMS text messaging program operated by CENTURY 21 Bradley Realty, Inc. (“CENTURY 21 Bradley,” “we,” “us,” or “our”).

By enrolling in or participating in our text messaging program, you agree to these Terms and our Text Messaging Privacy Policy.

1. Program Description

CENTURY 21 Bradley may use text messaging to communicate with affiliated agents and other authorized recipients regarding business-related matters.

Messages may include:

  • Listing graphics, property photographs, links, and marketing materials;
  • New-listing, price-change, pending, sold, and other property-related notifications;
  • Information concerning transactions, closings, deadlines, and office activities;
  • Company announcements and administrative communications;
  • Training information, meeting reminders, and event invitations;
  • Technology, marketing, operational, and support communications;
  • Responses to questions or requests; and
  • Other communications related to your affiliation or business relationship with CENTURY 21 Bradley.

Messages may be delivered through SMS, MMS, or another supported mobile messaging format.

2. Consent to Receive Messages

By providing your mobile telephone number and affirmatively opting in, you authorize CENTURY 21 Bradley, its employees, representatives, and authorized service providers to send text messages to the number you provided.

Messages may be sent manually or through automated technology or messaging platforms.

Your consent to receive text messages is voluntary. Consent is not a condition of employment, independent-contractor affiliation, receiving company services, participating in company programs, or purchasing any property, product, or service.

You represent that:

  • You are the subscriber or authorized user of the mobile number provided;
  • You are authorized to consent to receive messages at that number; and
  • The information you provide is accurate and current.

Do not enroll a mobile number belonging to another person without that person’s authorization.

3. Message Frequency

Message frequency will vary based on company activity, available listings, transactions, events, requested services, and your interaction with the program.

You may receive recurring messages. CENTURY 21 Bradley does not guarantee that messages will be sent according to a fixed schedule.

4. Message and Data Rates

Message and data rates may apply according to your wireless carrier and mobile service plan.

CENTURY 21 Bradley does not charge a separate fee for participating in the text messaging program. However, you are responsible for any charges imposed by your wireless carrier, including text messaging, data, roaming, or other applicable charges.

Contact your wireless carrier for information about your mobile plan.

5. How to Opt Out

You may stop receiving text messages at any time by replying STOP to a message from CENTURY 21 Bradley.

You may also communicate your request to stop receiving text messages through another reasonable method, including contacting us using the information provided below.

You may use words such as:

  • STOP
  • QUIT
  • END
  • CANCEL
  • UNSUBSCRIBE
  • OPT OUT
  • REVOKE

After you submit an opt-out request, you may receive one final non-promotional message confirming that your request has been processed.

Once your opt-out request has been processed, you will no longer receive messages through the applicable text messaging program unless you enroll again and provide renewed consent.

Opting out of text messages will not prevent CENTURY 21 Bradley from communicating with you through email, telephone calls, company systems, or other appropriate methods.

7. Changing or Reassigning Your Mobile Number

You agree to notify CENTURY 21 Bradley promptly if:

  • Your mobile telephone number changes;
  • Your mobile service is disconnected;
  • You are no longer the authorized user of the number; or
  • The number is transferred or reassigned to another person.

You should opt out before discontinuing use of a mobile number whenever possible.

You are responsible for ensuring that your contact information remains accurate. CENTURY 21 Bradley is not responsible for messages delivered to a number that you failed to identify as changed, disconnected, or reassigned.

8. Supported Carriers and Message Delivery

Text messaging service may not be available through every wireless carrier, device, or mobile plan.

Wireless carriers are not responsible for delayed or undelivered messages.

Message delivery is subject to effective transmission by your wireless carrier and may be affected by:

  • Network availability;
  • Carrier restrictions;
  • Device compatibility;
  • Service interruptions;
  • Internet or cellular coverage;
  • Technical failures; or
  • Circumstances beyond our reasonable control.

CENTURY 21 Bradley does not guarantee that every message will be delivered, received, or delivered within a particular period.

9. Privacy

Your participation in the text messaging program is also governed by our Text Messaging Privacy Policy.

We do not sell, rent, or share your mobile telephone number, text messaging consent, or opt-in information with third parties or affiliates for their own marketing or promotional purposes.

We may provide information to telecommunications providers, messaging platforms, technology vendors, and other service providers that assist us in operating and delivering the text messaging program.

These providers may use the information only as necessary to provide services on our behalf.

10. Use of the Messaging Program

You agree not to use the text messaging program to:

  • Send unlawful, threatening, abusive, defamatory, deceptive, or harassing content;
  • Transmit viruses, malicious code, or harmful files;
  • Attempt to gain unauthorized access to company systems or information;
  • Interfere with the operation or security of the messaging service;
  • Impersonate another person;
  • Submit confidential or sensitive personal information that is not appropriate for text messaging; or
  • Use messages or materials provided by CENTURY 21 Bradley in violation of applicable laws, company policies, licensing rules, advertising requirements, or intellectual-property rights.

Listing graphics, photographs, logos, templates, and other materials sent through the program remain subject to applicable copyright, trademark, branding, advertising, and company-use requirements.

11. Sensitive Information

Text messaging is not guaranteed to be a secure communication method.

Do not send Social Security numbers, passwords, banking information, credit-card information, medical information, account credentials, or other highly sensitive information through text messages.

CENTURY 21 Bradley may direct you to a more secure communication method when sensitive information is required.

12. No Emergency Services

The text messaging program is not an emergency service and should not be used to request emergency assistance.

Messages may not be reviewed or answered immediately. In an emergency, call 911 or contact the appropriate emergency-service provider.

13. Changes to the Messaging Program

CENTURY 21 Bradley may modify, suspend, restrict, or discontinue all or part of the text messaging program at any time.

We may also change:

  • The types of messages sent;
  • The telephone number or short code used;
  • The messaging provider;
  • The available features; or
  • The eligibility requirements for participation.

We are not liable for any modification, suspension, interruption, or discontinuation of the program.

14. Changes to These Terms

We may update these Terms periodically.

When changes are made, we will revise the effective date displayed at the top of this page. Material changes may also be communicated through text message, email, our website, company systems, or another reasonable method.

Your continued participation in the program after updated Terms take effect constitutes acceptance of the revised Terms, except where additional consent is required by law.

15. Disclaimer of Warranties

The text messaging program is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, CENTURY 21 Bradley makes no warranties, express or implied, regarding the availability, accuracy, timeliness, security, reliability, or operation of the messaging program.

Information provided by text message is for general business and informational purposes. Recipients remain responsible for verifying important listing, transaction, appointment, deadline, and compliance information through the appropriate official source.

16. Limitation of Liability

To the fullest extent permitted by law, CENTURY 21 Bradley and its employees, representatives, affiliates, and service providers will not be liable for losses or damages resulting from:

  • Delayed, failed, incomplete, or misdirected messages;
  • Inaccurate or outdated mobile contact information;
  • Network, carrier, device, or platform failures;
  • Unauthorized access to a recipient’s mobile device;
  • Reliance on information contained in a text message without appropriate verification; or
  • Suspension or discontinuation of the messaging program.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Governing Law

These Terms will be governed by and interpreted under the laws of the State of Indiana, without regard to its conflict-of-law principles.

Any dispute concerning these Terms or the text messaging program will be subject to any applicable agreements between you and CENTURY 21 Bradley and the jurisdiction of the appropriate state or federal courts located in Indiana, unless otherwise required by law.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

19. Entire Agreement

These Terms, together with the Text Messaging Privacy Policy, your opt-in authorization, and any other applicable agreement or company policy, constitute the terms governing your participation in the CENTURY 21 Bradley text messaging program.
